Terms of Service

Xinchuang manufactures and supplies the following industrial machinery:

• Cup Filling and Sealing Machines
• Spout Pouch Filling and Capping Machines
• Ice Lolly Tube Filling and Sealing Machines
• Blister Packaging Machines
• Pasteurizer Production Lines

All products are designed for B2B commercial and industrial use only. Our services include equipment customization, installation support, training, and after-sales maintenance.

3.1 Quotations

All quotations are valid for 30 days unless otherwise specified. Prices are subject to change based on raw material costs, customization requirements, and market conditions.

3.2 Payment Terms

• Standard payment terms: 30% deposit upon order confirmation, 70% balance before shipment
• Payment methods: T/T (Telegraphic Transfer), L/C (Letter of Credit) at sight
• All banking charges outside China are buyer's responsibility
• Late payment may result in order delays or cancellation

4.1 Delivery Terms: Unless otherwise agreed, all deliveries are made FOB (Free on Board) from our factory in Guangdong, China.

4.2 Delivery Time: Standard delivery time is 15-45 working days depending on machine complexity and customization requirements.

4.3 Risk Transfer: Risk of loss or damage passes to buyer upon delivery to the carrier at our facility.

4.4 Force Majeure: We are not liable for delays caused by circumstances beyond our reasonable control, including natural disasters, government actions, or supply chain disruptions.

5.1 Quality Standards

All equipment is manufactured according to international quality standards and undergoes rigorous testing before shipment.

5.2 Warranty Period

• Mechanical parts: 12 months from installation or 15 months from shipment, whichever comes first
• Electrical components: 12 months from installation
• Wearing parts and consumables are excluded from warranty

5.3 Warranty Coverage

Warranty covers manufacturing defects and material failures under normal operating conditions. Damage caused by misuse, improper maintenance, or unauthorized modifications voids the warranty.

6.1 Installation Support: We provide remote installation guidance and technical documentation. On-site installation services are available at additional cost.

6.2 Training: Basic operation training materials and video tutorials are provided. Advanced training programs are available upon request.

6.3 Technical Support: Email and phone support available during business hours (GMT+8). Response time: 24-48 hours for technical inquiries.

7.1 Maximum Liability: Our total liability for any claim shall not exceed the purchase price of the specific equipment involved.

7.2 Excluded Damages: We shall not be liable for indirect, consequential, special, or incidental damages, including lost profits, production delays, or business interruption.

7.3 Safety Compliance: Buyers are responsible for ensuring compliance with local safety regulations, obtaining necessary permits, and providing adequate operator training.

8.1 Proprietary Rights: All designs, technologies, and documentation remain our intellectual property.

8.2 Confidentiality: Buyers agree to maintain confidentiality of technical specifications and proprietary information.

8.3 Restrictions: Reverse engineering, copying, or unauthorized reproduction of our equipment is strictly prohibited.

9.1 Export Licenses: Buyers are responsible for obtaining necessary import licenses and permits in their jurisdiction.

9.2 Compliance: All transactions must comply with Chinese export regulations and international trade laws.

9.3 Restricted Countries: We reserve the right to refuse orders from countries subject to international sanctions or trade restrictions.

10.1 Governing Law: These Terms are governed by the laws of the People's Republic of China.

10.2 Jurisdiction: Any disputes shall be resolved through arbitration in Guangzhou, China, under the rules of the China International Economic and Trade Arbitration Commission (CIETAC).

10.3 Language: All legal proceedings shall be conducted in English and Chinese, with Chinese taking precedence in case of discrepancies.

11.1 Amendments: We reserve the right to modify these Terms at any time. Updated Terms will be posted on our website with the effective date.

11.2 Severability: If any provision of these Terms is found invalid, the remaining provisions shall continue in full force.
